\u201cIf the parent has already found a provider, and the provider accepts the voucher, it certainly can be a course that they should consider,\u201d said Shore. \u201cIt would be probably the fastest course.\u201d<\/p>\r\n

Otherwise, families may need to file a legal claim called a due process complaint that is heard by an impartial hearing officer, a process that can take time to resolve.<\/p>\r\n\r\n

\r\n

\u201cWhat you\u2019re looking at is several months, if not longer,\u201d Cutler said.<\/p>\r\n

Plus, winning a favorable ruling from an impartial hearing officer isn\u2019t guaranteed, and city officials would likely challenge a family\u2019s legal claim by noting they missed the filing deadline, which is enshrined in state law.<\/p>\r\n

Shore said a family still \u201ccan have a claim\u201d against the city even if they missed the deadline. But she didn\u2019t want to generalize about a family\u2019s chances of prevailing because the outcome of a given case is highly dependent on the specific facts.<\/p>\r\n

Education Department officials argued that families who missed the deadline \u201cessentially have no legal recourse\u201d and therefore have little to lose by accepting the city\u2019s offer.<\/p>\r\n

\u201cThese students are entitled to services [in] September, October, November, December,\u201d said Shore. \u201cGiving up their right to make-up services for that entire time period, again, is a parent\u2019s consideration.\u201d<\/p>\r\n\r\n<\/div>","":null,"settings":""}}],"relationships":{"":null,"article_type":[83],"topics":[28],"misc_topics":[198]},"misc":{"search_results":{"":null,"excerpt":"","featured_image":12976}}},"yoast_head":"\nNYC asks private school families to waive their right to sue in exchange for special education services -
